What isThe Employment Equity Commission?
The EEC (Employment Equity Commission) helps employers create fair, equal and inclusive workplaces in Namibia.
It was created by the Affirmative Action (Employment) Act, 1998, and works under the ministry of Justice and Labour Relations
“If your business has 10 or more employees, the law requires you register with the EEC and submit an Affirmative Action Report every year”
Who needs to register with EEC
You are a ''relevent employer'' if: you have 10 or more employeesyou are a State-owned enterprise, local authority, regional council, or ministry
This Means:
You must: Register with the Employment Equity CommisionSubmit yearly reports showing what you're doing to promote fairness in your business
Why this is Important?
By Complying with the EEC, your business :
- Gets a Compliance Certificate.
- Avoids fines or Legal issues
- Helps build a fair, skilled workforce
- Shows you support equal opportunities for all Namibians
What is an Affirmative Action Report?
This is a report that shows:
- The makeup of your workforce (e.g women, youth, previously disadvantaged groups)
- How you are recruiting, promoting, and training people fairly
- Your plans to improve representation and fairness
You must submit this report every year, even if your business hasn’t changed.
How to Register & Comply
Here are the basic steps to follow:
- Download and read the Affirmative Action Act
- Fill in the Employer Registration Form
- Prepare your first Affirmative Action Report
- Submit your report to the EEC by the due date
- Request your Compliance Certificate if needed

Required Documents
To comply with EEC requirements, you’ll need:
- A copy of your BIPA business registration
- List of all employees (including job titles, gender, nationality, etc.)
- Your employment policies (e.g. how you hire, promote, and train)
- A filled-in Affirmative Action Report
